By accessing or using any of our services — including the Ignite™ Platform (igniteplatform.ai), HeartSpark™, MarketSpark™, and any related applications or websites (collectively, the "Services") — you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

If you do not agree to these Terms, do not access or use the Services.

1. Who We Are

Golden Catalyst is the parent company behind BehaviorStack™ technology. References to "we," "us," or "our" mean Golden Catalyst and its affiliated products.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using our Services you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

3. Your Account

Some Services require you to create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately at support@igniteplatform.ai of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Services only for lawful purposes. You must not:

• Generate content that is illegal, defamatory, harassing, or abusive.
• Attempt to reverse-engineer, scrape, or extract our underlying AI models or algorithms.
• Sell, resell, or sublicense access to the Services without our written consent.
• Use automated scripts that impose excessive load on our infrastructure.
• Impersonate any person or entity, or misrepresent your affiliation.
• Circumvent any access controls, rate limits, or security measures.

5. AI-Generated Content

Our Services use BehaviorStack™ Smart AI to generate content. You acknowledge that:

• AI-generated content may not always be accurate, complete, or appropriate for every situation.
• You are solely responsible for reviewing and deciding whether to use any AI-generated content.
• We do not guarantee specific outcomes from using AI-generated content.
• Content generated through our Services does not constitute professional legal, financial, medical, or relationship advice.

6. Credits and Payments

Certain features require credits or a paid subscription. All purchases are final unless otherwise stated. We may change pricing at any time with reasonable notice. Credits have no cash value, are non-transferable, and may expire as described in our billing documentation.

7. Intellectual Property

All intellectual property in the Services — including BehaviorStack™ technology, algorithms, branding, designs, and software — is owned by Golden Catalyst or its licensors. These Terms grant you only a limited license to use the Services as described herein.

You retain ownership of content you submit. By submitting content you grant us a non-exclusive, worldwide, royalty-free license to process that content solely to provide the Services to you.

8. Privacy

Your use of the Services is also governed by our Privacy Policy, incorporated into these Terms by reference.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN CATALYST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL RESULTING FROM YOUR USE OF THE SERVICES.

11. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Services ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Florida.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above. Continued use of the Services after changes constitutes acceptance of the revised Terms.
